This is an agreement between Farmbot and its developers, interchangeably referred to in the following document as “Farmbot”, “developers”, “we”, “us”, “bot”, and “our service”, and you, interchangeably referred to in the following document as “you”, “user”, and “player”. This agreement outlines the rights and responsibilities of either party in relation to your use, interaction, and relationship with the service.
By using our services (Discord server, website), you acknowledge, agree, and will comply with our terms of service and privacy policy.
This contract is governed and constructed in accordance with the laws of the province of Quebec without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located within the Governing Jurisdiction for the resolution of any disputes arising out of or relating to this Agreement.
The failure or delay by either party to exercise a right or remedy under this agreement shall not constitute or be interpreted as a waiver of that right or remedy, nor shall it prevent its exercise in relation to any past, concurrent, or future breach of this agreement.
If any provision of this Agreement is found by a court of the governing jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed severed from this Agreement, and the remaining provisions shall continue in full force and effect.
In order to comply with COPPA and Discord's ToS, users who use our services must be at least 13 years old. Moreover, we may ban users at our discretion, and such users are no longer permitted to use our services.
The permitted uses of our services should be logical and morally ethical. This boils down to a non-exhaustive list of what you can and cannot do with our services:

We reserve the full discretion to ban users or servers that use our service in bad faith (see Your Responsibility and see User Termination).
You agree not to use Farmbot in any manner that would cause Farmbot or its hosting providers (including but not limited to Railway) to violate their terms of service, acceptable use policies, or applicable laws.
You also agree to indemnify and hold harmless Farmbot, its developers, and affiliates from and against any claims, damages, and penalties arising from your potential misuse of Farmbot, including but not limited to actions that may cause Farmbot, its developers, or its affiliates to be in violation of the terms of third-party providers and services.
Farmbot and its maintainers reserve the right to terminate, suspend, or restrict your access to and interactions with the bot at any point at their discretion.
Our services are limited to the countries where Discord is limited to providing service. Due to our services being deployed on Railway, Farmbot and its maintainers make no warranties, expressed or implied, relating to the bot's reliability, uptime, or availability and provide the bot on an “as-is” and “as-available” basis. However, we still aim to have our service online 24/7 to the best of our ability.
In the unlikely event that we decide to terminate our services, we reserve the full discretion to do so.
The assets, including all content, features, and functionality are owned by, and considered intellectual property, of Farmbot and/or its licensors or other providers of such material. These assets are protected by the relevant copyright, trademark, and other related proprietary rights laws, both domestic and international.
Your use of these assets is limited to purposes solely relating to your personal, non-commercial engagement with our service as a current or prospective user. You may not copy, modify, publicly display, republish, reproduce, sell, or transmit any of the material and assets provided to you through our service. Furthermore, you may not delete, alter, or otherwise modify the copyright, trademark, or any other proprietary rights notices from copies of the materials of the service.
However, in instances where you are in compliance with these terms, you are permitted to use elsewhere, including on other sites and forms of media, unaltered copies of publicly available content and assets of the service for the limited, non-commercial, and personal use of discussions relating to such content under the provision that its usage and distribution is compliant with these terms and the original proprietary rights notices of the copies of such content and assets are included in a preserved and unmodified state with sufficient attribution to the service and its affiliates.
In the unlikely event that our database, deployed on Railway, corrupts, loses and/or leaks partially or fully a user’s stored data — whether due to a data breach, corruption, outage or other causes within or beyond our control — we are not to be held responsible for any damages, losses, leaks or claims. Because of these unlikely events, your use of our services is at your own risk.
To the extent permitted by the law, Farmbot and its maintainers are not to be held liable for any damages, including but not limited to direct, indirect, consequential and punitive damages arising from your connection to, relation with, or usage of the bot, including but not limited to data loss, moderation actions, and downtime.
In the event a change applies to our terms of service, we will post the changes under the same link with which you are accessing the current version of the terms of service. If you do not agree with our current or new terms, please do not use our services.
